Executors, Estates & Probating a Will in British Columbia

Probate, Executors & Estates

The Executor's Role & Duties?

The Executor of an Estate is a person appointed by the deceased in their Last Will and Testament. You are not obligated to accept this appointment.

As the Executor, you may have to confirm and paying any outstanding debts owed by the deceased; collect, account for and distribute the deceased's assets according to the provisions of a valid Will, setting up any Trusts specified in the Will and other matters set out in it. You may have to apply for the Will to be Probated by a Court of Law.

Estate

The word "Estate", in this context, generally refers to both the assets and liabilities of a deceased person and the process and organization of the distribution of the deceased person’s assts and liabilities prior to distribution, including the process of paying debts,  filing tax returns, selling assts and distributing assets and monies to beneficiaries.
